Terms of Shipping, Cancellation and Refunds

1. Products for which orders placed by you through this website will be dispatched by us within 3 working days after your payment is approved by online payment gateway. Despatch of products against your order is subject to availability of such products with us.
2. We will despatch the products through any mode which we feel appropriate for delivering the products to you in a reasonably quick time and without any damage and/or loss, depending on the place of delivery requested by you in your order.
3. We reserve the right to reject an order placed by you and not despatch the products.
4. In case products ordered by you are not despatched by us for whatever reason, you are eligible for refund of the amount received by us from you for the respective transaction through this website and the amount will be refunded by us within 7 working days from the date of order. Eligible refunds will be paid through the online payment gateway only to the account from the money is received by us for the respective transaction after deducting the applicable payment gateway charges.
5. For cancellation of your order, you can send email to info@infinitheism.com with the following details;

• Order id/reference no
• Order date
• Name of the Purchased product
• Amount paid

6. For products you can cancel your order within 24 hours of placing your order,for which you will be eligible to receive the refund of money. If you cancel your order after 24 hours of placing your order, you are not eligible for refund.
7. For Digital/(non-physical) products you can cancel your order within 3 days from the date of purchase. If you cancel your order after 3 days of placing your order, you are not eligible for refund.
8. It will be your responsibility to ensure you have adequate infrastructure for purchasing our products through this website or website(s).
9. Eligible refunds will be paid within 7 working days. Eligible refunds will be paid through the online payment gateway only to the account from which money is received by us for the respective transaction after deducting the applicable payment gateway charges. Request for refunds through any other mode will not be accepted by us.
10. Products once purchased by you cannot be exchanged for any other product.
11. We take utmost care to pack the products in such a way that you will receive the same without any damage. However, in case you receive any product from us in a damaged condition, you can notify us at our contact information within 48 hours of receiving such damaged products. We will despatch the free replacement product to you in the place of damaged products. In case you notify us about the damage after 48 hours of receiving the products, you are not eligible to receive the free replacement.

Indemnification

Maximum liability

Our liability to you for any loss or damages whether direct or consequential, due to whatever reason including but not restricted to delayed delivery or non-performance of our products, etc., can be to the maximum of the amount paid by you to us for that specific product and in any case cannot exceed the same.

Class Action Waiver

Where permitted under the applicable law, you and infinitheism agree that you may bring claims against the other only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, where permitted under the applicable law, unless both you and infinitheism agree otherwise, the court may not consolidate more than one person’s claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

Disputes

1. The Terms shall be governed by the laws of the Republic of India and the courts at Chennai shall have exclusive jurisdiction.
2. Any controversy or claim arising out of or relating to an alleged breach of this Agreement or the use of this Website shall be settled by binding arbitration by a sole arbitrator appointed by infinitheism to a dispute in accordance with the Arbitration and Conciliation Act, 1996. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The language of arbitration shall be in English and the place of arbitration shall be at Chennai. All disputes are subject to courts of Chennai jurisdiction.
3. You Agree to submit to the sole and exclusive jurisdiction of courts at Chennai.

You shall bear your own legal and other costs in relation to the Dispute and you agree to reimburse the Company for the legal and other costs (including, but not limited to, legal fee) in relation to the Dispute. Notwithstanding the provision herein, you acknowledge that we are free to choose the jurisdiction of our preference as mentioned above. You, hereby, acknowledge that such choice made by us, is without regard to where in the world you are located, or from where in the world you have accessed the Website.
